Terms of service
Short, because the arrangement is simple: you bring products, we make photographs of them, you own the photographs, and you pay for the ones that passed our checks.
Who these terms are between
These terms are an agreement between Stillhouse (a sole proprietorship based in British Columbia, Canada) ("Stillhouse", "we") and the business that uses Stillhouse ("you"). Whoever accepts them on a business's behalf confirms they may bind it. Stillhouse is for businesses, not consumers, and for people aged 18 or over.
The service
Stillhouse is a studio that makes product photographs, short product clips and listing images from a merchant's own product images, on sets and with models the merchant defines. It is available as a website and as an app for Shopify. Using either means agreeing to these terms. Stillhouse Try-On, the separate app that lets a store's shoppers see a product on themselves, is covered by these terms and by its data processing addendum.
Some features are marked as early or beta. They may change or be withdrawn, and we say so in the studio when they are.
Your account and your team
- A workspace always has an owner, who is responsible for who is invited and with which role.
- Keep sign-in details to yourselves. Everything done from a workspace's seats is treated as done by you.
- Connecting a store gives us permission to read your products and to write to them what you approve.
Your content
- You keep every right to the images and text you upload. You give us permission to process them to run the service, and nothing more.
- You are responsible for having the rights to what you upload: your products, your brand, and any real person you use to define a model.
- The studio learns from what your workspace approves and turns down, to choose better for you next time. What it learns stays in your workspace.
The images we make
- As between you and us, you own the frames, clips and crops the studio makes for you, and may use them anywhere, including in advertising. We assign to you whatever rights we have in them.
- Images made by AI models may not be protected by copyright everywhere, and a model can make something similar for someone else. We do not promise exclusivity.
- Generated images can be wrong in ways our checks do not catch: a label, a colour, a detail. Review a frame before you publish it. You are responsible for what you publish, and for it describing the product honestly.
- Every frame is marked as AI-generated in its file metadata, and frames with a generated person are marked as such. Some marketplaces and laws require you to declare this; doing so where required is your responsibility, and the studio tells you which frames it applies to. Do not remove the marker where a venue relies on it.
Real people and models
- Use a real person as a model only with their written permission to make images of them for your store. We record who confirmed it and when.
- Never use anyone under 18 as a model, real or described.
- We remove a model and every frame made from it when you, or the person shown, ask.
Publishing and autopilot
When you approve a frame for publishing, or turn on autopilot, you instruct us to add images to your store's product pages on your behalf. Autopilot shoots and publishes by the settings you choose and can be turned off at any time; a publish can be undone from the studio. What appears on your store remains your responsibility.
Credits and plans
- A credit is one delivered frame. Frames we are not confident in are delivered flagged, with the reason, and are charged like any other; every regenerate you ask for is a new frame and costs a credit. Takes our checks discard before delivery are never charged. Clips and 3D views cost the credits the studio shows before you start them.
- Plans renew monthly until cancelled. Each month the workspace is topped up to its plan's allowance; unused credits do not roll over. An upgrade tops the workspace up to the new allowance at once. Credit packs, where offered, add to the balance and are spent like any other credit.
- Website accounts pay through Stripe. Stores that install the app from the Shopify App Store pay through Shopify Billing, on Shopify's terms. A workspace stays on the rail it started paying on.
- Prices exclude taxes, which are added where the law requires. We give at least 30 days' notice of a price change, and it applies from your next renewal.
- If a payment fails, the workspace is not topped up again until it succeeds; your work stays.
- There is no free plan and no trial. Cancelling ends the plan at the close of the paid period; your sets, models, shoots and frames stay, and shooting resumes when you choose a plan again.
- Fees are non-refundable except where the law says otherwise, or where the service failed and we could not put it right.
What you may not do
- Make images of a real person without their permission, or of anyone under 18 as a model.
- Make images that infringe someone else's trademark or copyright, or that are deceptive about what a product is.
- Use the service to make sexual, violent or hateful imagery, or anything our image providers' policies forbid.
- Try to get around the studio's checks, limits or billing, probe or overload it, or copy it by reverse engineering.
- Resell access to the service, or scrape it.
We may suspend a workspace that does any of these, and will say why.
Other services
Stillhouse relies on other companies to work: image and language model providers, Shopify and the other stores you connect, payment processors and hosting. Their outages can affect the studio, and their own terms apply to your use of them. The privacy policy names them.
What we promise, and what we do not
We work to keep the studio available and to make frames that are honest to the product. Beyond that, the service is provided as it is, without warranties of any kind, to the extent the law allows. Our total liability to you is limited to the fees you paid us in the twelve months before a claim, and we are not liable for indirect loss, lost profits or lost sales. Nothing here limits liability that the law does not allow to be limited.
You will cover our reasonable costs if a third party brings a claim against us over content you uploaded or published, or over your breach of these terms.
Ending things
You can delete your workspace, or uninstall the Shopify app, at any time. We may end the agreement with 30 days' notice, or at once for a serious breach of these terms. Either way you can export your frames first. The sections on the images we make, liability and the law survive the end of the agreement.
The rest
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, and disputes go to its courts. If a term is unenforceable the rest stand. Not enforcing a term is not giving it up. We announce material changes to these terms in the studio or by email at least 30 days before they apply, and update the date above; continuing to use the service after that means accepting them.
